Critical Incident Steps
A critical incident includes: duty‑related shootings, in‑custody deaths, serious use‑of‑force situations, or vehicle pursuits resulting in death or serious injury.
-
Immediately contact an FOP emergency legal assistance representative using the numbers above.
-
Notify an immediate family member to inform them of the incident.
-
Seek medical attention as needed.
-
Consult with an FOP attorney, either in person or by phone. Attorneys will call you first and, when available, respond in person.
-
If you are asked to provide an interview, first determine whether it is part of a criminal or administrative investigation.
-
For criminal investigations, do not agree to an interview before speaking with an attorney.
-
To determine the type of interview, ask who will be conducting it:
-
Internal Affairs → administrative*
-
Investigator/Detective → criminal
-
-
*Employees generally cannot refuse administrative questioning. It is essential that you clearly understand which type of interview you are participating in. Statements made during an administrative interview are protected under Garrity Rights and cannot be used against you in a criminal case.
